農用中央版《農業用地興建農舍辦法》新修法內容尚未完全公告，宜蘭縣政府擬先行修訂地方農舍興建法規，待中央公告新法再無縫接軌。圖為農委會副主委沙志一的宜蘭農舍外觀。（簡榮輝攝）

農地農舍政策自宜蘭縣政府4月開出第一槍後，農委會從善如流，9月修正《農業用地興建農舍辦法》。如今，經營計畫書內容的審查原則尚未完成簽核程序，宜蘭縣政府為了避免出現法令空窗期，已再著手修正《宜蘭縣興建農舍申請人資格及農舍建築審查辦法》，預計2周內預告，1個月內完成公告。「地方與中央共同捍衛農地農用。」宜蘭縣農業處處長楊文全表示，當初宜蘭縣政府擔憂農地蓋滿農舍，4月落實農地農用政策，上月獲農委會正面回應，除了修正中央母法，同時邀集各縣市政府討論訂定執行細則，並將會議紀錄函送各地方政府。

農舍興建 修法空窗期　宜縣補強地方法規

農地農舍政策自宜蘭縣政府4月開出第一槍後，農委會從善如流，9月修正《農業用地興建農舍辦法》。如今，經營計畫書內容的審查原則尚未完成簽核程序，宜蘭縣政府為了避免出現法令空窗期，已再著手修正《宜蘭縣興建農舍申請人資格及農舍建築審查辦法》，預計2周內預告，1個月內完成公告。「地方與中央共同捍衛農地農用。」宜蘭縣農業處處長楊文全表示，當初宜蘭縣政府擔憂農地蓋滿農舍，4月落實農地農用政策，上月獲農委會正面回應，除了修正中央母法，同時邀集各縣市政府討論訂定執行細則，並將會議紀錄函送各地方政府。

楊文全指出，目前農委會對於農舍興建辦法的「農民資格」、「經營計畫格式」已完成，至於農業經營實績、農地經營區塊原則、填土與排水計畫對環境影響等審查原則也已清楚，不過，中央尚未完成簽核程序。由於農委會簽核《農業用地興建農舍辦法》的時程未訂，縣府擔憂等待中央法令公告的空窗期，因此以上月各縣市政府與農委會討論的會議紀錄為依據，修改《宜蘭縣農舍申請人資格及農舍建築審查辦法》，增設、刪減部分條文。楊文全說，地方修法用意主要是讓地方、中央彼此法規無縫接軌，地方修法版預計2周內預告，1個月內公告。不過，若中央修法版本於1個月內先行公告，地方修法版本屆時將不予公告，宜蘭縣將以中央修法版本為準。(中國時報)，
