    　吳季剛認為，他去年2月及3月間向歐盟和美國申請「MISS WU」商標註冊均經核准公告，足見商標具有識別性；另外，他也提出「Dr.Ku」等類似商標曾被核准案例，但智慧財產局差別待遇，有違「平等原則」。
    　另外，原告認為就算「MISS WU」不具先天識別性，但仍具備「後天識別性」。
    　吳季剛訴訟代理人指出，吳季剛的「JASON WU」品牌聞名於世；而主攻低價年輕品牌的「MISS WU」品牌，透過「JASON WU」宣傳後已為民眾熟知。律師並提出相關媒體報導，佐證「MISS WU」已具備後天識別性。
    　法院則認為，未經設計的「MISS WU」商標圖樣，是既有常見詞彙並非新創文字，且圖樣未經特殊設計，因此不具先天識別性。
    　法院表示，雖原告提出媒體報導佐證，但仍無法藉此推論「JASON WU」的後天識別性可延伸到「MISS WU」品牌；且原告未提及該商標市場占有率等數據，證明「MISS WU」與其他品牌有所區隔。
    　另外，判決書指出，原告提出智慧財產局曾核准類似案件，法官則認為案情有別，基於商標審查個案拘束原則，不能以此作為註冊論據。法院審理後予以駁回，全案可上訴。1020121

4G喊價 破500億

    　昨日競標過程最戲劇化的是，

，原本無人出價的700MHz的A1、900MHz的B1全部動起來，12個區塊頻譜首次出現全部有人出價情形，市場人士觀察認為，這表示4G競局已趨向白熱化，距離決標期不遠，有機會在中秋節前後拍板。
    　市場分析指出，4G仍在出價階段，4G總標金將繼續往上飆高，是否如外資所言、將高出底價1倍以上並衝破780億元？仍有待觀察。
    　C5頻段昨日再度往上飆高至134億元，700MHz的A1頻段首次出價至47.4億元，與A2、A3價格相同，三個區塊頻寬都各10MHz，頻寬達15MHz的A4目前出價至71.1億元，顯示已有業者決定從1800MHz的C5頻段棄守、轉戰C5其它區塊。
    　各頻段中，又以B1標金16.5億元最低，主要因為該頻段可能受到電子收費系統（eTag）干擾。
    　NCC統計指出，已進行8天累計80回合行動寬頻業務釋照競價作業，由6家競價者出價，暫時得標價總計512.6億元，各頻段暫時得標價700MHz頻段213.3億元、900MHz頻段59.8億元、1800MHz頻段239.5億元，競價作業將於今天繼續進行。，

亞太電信傳出售 葉匡時：樂觀其成

    　至於買家是不是中華電信？葉匡時說，中華電信並未與他討論過此事，站在大股東的立場，交通部希望中華電從併購同業是否有利公司長遠發展的專業角度自行判斷。
    　中華電信總經理石木標針對此，表示不予評論。
    　市場傳出中華電信雖然拿下4G高達35MHz上限、以及C5最漂亮的頻譜，但是，面對台灣大哥大打算結盟鴻海、共同對抗中華電信，備感壓力。
    　而台灣大拿下4G共30MHz頻寬、鴻海透過國碁取得20MHz頻寬，兩家已經決定在4G手機、網路建設合作，未來進一步深入結盟關係，兩家公司合計50MHz的4G頻寬資源，恐怕將對中華電信將造成龐大威脅。
    　因此，儘管亞太電信目前經營CDMA-2000的3G技術，與中華電信WCDMA的3G技術完全不同，但是，若從頻譜資源效益來說，中華電信並未取得700MHz頻譜，而亞太電信剛好在這次4G拿下一塊4G頻譜，可以讓中華電未來在700/900/1800MHz補實頻寬資源。，

拉攏中、俄 朴槿惠倡歐亞統合

    　朴槿惠特別針對團結的大陸這一目標擘畫三項具體方案，

，首先是興建從南韓釜山港市出發，

，貫通北韓、俄羅斯、中國、中亞，直到歐洲的「快捷絲路」（Silk Road Express）歐亞鐵公路網，以形成亞歐複合物流網絡。
    　其次是構建「歐亞能源網」。朴槿惠表示，「應連接區域內的戰略網、天燃氣與石油輸送管道等能源基礎設施，推動共同開發中國頁岩氣、東西伯利亞石油與天然氣等，實現歐亞能源雙贏合作」。
    　第三，她主張促成「歐亞經濟統合」。她說「韓中日自由貿易協定等貿易自由化談判逐漸加速，如果將其與區域全面經濟夥伴關係協定（RCEP）及跨太平洋貿易與投資夥伴關係協定（TPP）等區域內外的貿易協定連接起來，將會形成一個龐大的統合市場」。
    　朴槿惠說：「假如我們可為區域經濟整合逐步拆除貿易壁壘，歐亞大陸可以成為類似歐盟的單一市場。」
    　俄國總統普丁即將於11月訪問南韓與朴槿惠舉行峰會，而普丁相當重視南北韓與俄國能源合作的可能發展。國民經濟諮詢會議支援團長劉炳圭（音）指出，如果南韓與俄羅斯能夠在能源合作取得共識，北韓就沒有理由反對，北韓問題便可以順其自然獲得解決。，
